The National Construction Code (NCC) is Australia’s primary set of technical design and construction provisions which sets out the minimum required level for the safety, health, amenity, accessibility and sustainability of certain buildings. Compliance with the NCC is achieved by complying with the Governing Requirements and the Performance Requirements.

The Performance Requirements can be satisfied by:

  1. Meeting the deemed-to-satisfy provisions, which are the prescriptive, descriptive technical design requirements outlined by each clause of the building code;

  2. A Performance Solution; or

  3. A combination of (1) and (2).

Performance Solutions are an alternative pathway to achieving compliance in instances where meeting the deemed-to-satisfy provisions is not feasible or desirable, for example in relation to:

  • Complex or unique site constraints

  • Existing building conditions that can’t reasonably be modified such as heritage buildings

  • The particular use and function of a building where a ‘one-size-fits-all’ approach is inappropriate

  • Supporting innovative design and creative outcomes

The Performance Solution Process

The process starts with the preparation of a Performance-Based Design Brief (PBDB) in collaboration with key stakeholders such as building owners, project managers, architects, the approval authority, and other relevant agencies and representatives.

The PBDB outlines the critical activities and outcomes of the performance-based design process as agreed by stakeholders, and when finalised, provides a high degree of confidence the proposed design is likely to be approved. Developing a PBDB ensures all stakeholders are aligned from the beginning and streamlines the approval process.

During the PBDB process, the proposed Performance Solution is evaluated according to one or more of the Assessment Methods outlined in the NCC in order to assure compliance. The results are evaluated, and the final Performance Solution report is produced to confirm the Performance Requirements have been met.
